Introduction

Welcome to DAHLIA, a personal assistant application (“App”) operated by DAHLIA Intelligence Inc. (“we”, “us”, or “our”), a company based in Nova Scotia, Canada. These Terms and Conditions (“Terms”) govern your access to and use of the DAHLIA App and related services (collectively, the “Service”). Please read these Terms carefully before using the App.

By downloading, installing, or using DAHLIA, you agree to be bound by these Terms, as well as our Privacy Policy (which is incorporated by reference). This is a legal agreement between you and DAHLIA Intelligence Inc. If you do not agree with these Terms or our Privacy Policy, you must not use the App or Service.


Eligibility

Minimum Age: You must be at least 13 years old to use DAHLIA. The App is not intended for children under 13. If you are under the age of majority in your jurisdiction (for example, under 18 years old in many regions) but at least 13, you should review these Terms with a parent or legal guardian. By using the App, you represent that you meet these age requirements and, if you are a minor, that your parent or guardian has reviewed and agreed to these Terms on your behalf.


Description of the Service

DAHLIA is a personal assistant app designed to help manage your tasks and integrate into your digital life. The Service uses artificial intelligence and connects with your existing apps and accounts to assist you with daily activities. Key features of DAHLIA include:

- Web Search and Information Retrieval: DAHLIA can search the web to find information and answer your questions in a conversational manner.  

- AI Chat and Writing Assistance: You can chat with DAHLIA to get help with writing tasks, brainstorming ideas, or general inquiries. DAHLIA uses OpenAI’s language‑processing technology to generate human‑like responses and suggestions.  

- Email Drafting and Management: With your permission, DAHLIA can draft emails, summarize your inbox, and even help send emails on your behalf through integration with your Apple iCloud, Gmail, Outlook, and any other accounts you connect.  

- Calendar and Reminders: DAHLIA can create, edit, and delete calendar events, as well as set reminders for you, by integrating with your Apple, Google, and Microsoft calendars and reminder apps.  

- Personalized, Autonomous Assistance: Over time, DAHLIA learns from your interactions to provide more tailored assistance. The goal is for DAHLIA to evolve into a fully autonomous assistant that helps organize your communications, manage tasks, and seamlessly coordinate various aspects of your digital life.

The Service is provided via a mobile application (currently available on iOS through the Apple App Store). Some features require an active internet connection and may depend on integration with third‑party services or accounts, as described below.


User Accounts and Apple Integration

To use certain features of DAHLIA, you may need to create a user account or sign in through a supported method. You are responsible for maintaining the confidentiality of your account credentials and any passwords (including any Apple app‑specific password used for integration, described below), and for all activities that occur under your account.

Apple App‑Specific Password: DAHLIA integrates with Apple services (such as iCloud Mail, Calendar, and Reminders) using Apple’s app‑specific password mechanism. You may be required to generate a unique app‑specific password for DAHLIA via your Apple ID account settings. By providing this password in the App, you authorize DAHLIA to access and interact with your Apple account data (for example, to read your inbox, send emails, or manage your calendar events and reminders) on your behalf. We will only use this Apple credential to perform the functions you have enabled and requested within the DAHLIA App.

You must ensure that any app‑specific password or other credentials you provide to DAHLIA are kept secure. Do not share this password with anyone else or use it for any other application. If you suspect any unauthorized access to your Apple account or to DAHLIA, you should revoke the app‑specific password via your Apple ID settings and notify us immediately. You can revoke DAHLIA’s access at any time by deleting the app‑specific password in your Apple account settings (which will disable the integrated email/calendar features of the Service until a new password is provided).

Please note that while DAHLIA integrates with Apple services, DAHLIA Intelligence Inc. is independent from Apple Inc. Your use of Apple services via DAHLIA is subject to Apple’s own terms and conditions (such as Apple’s iCloud Terms). Apple is not responsible for the operation of the DAHLIA App, and we (not Apple) are solely responsible for providing customer support for DAHLIA.


Permissions and User Responsibilities

By using DAHLIA, you grant us the permissions necessary to operate on your behalf within the integrated services. This means you allow us to access data from your connected accounts (for example, fetching your emails or calendar events) and to make changes as instructed by you (for example, sending an email you drafted or adding a calendar entry). You agree that you have the rights and authority to grant these permissions for any accounts or data you connect to DAHLIA.

When using the Service, you agree to:  

- Provide Accurate Information: Ensure that any information you provide to us is true, accurate, and up‑to‑date. If you create an account, you will keep your registration information (such as your contact details) current.  

- Safeguard Your Credentials: Keep your login credentials and any integration passwords (like the Apple app‑specific password) confidential and secure. You are responsible for all activity that occurs under your account, so do not share your passwords or give others access to DAHLIA through your account.  

- Use the Service Lawfully: Use DAHLIA only for lawful purposes and in accordance with these Terms. You agree to comply with all applicable laws and regulations when using the App.  

- Be Responsible for Your Content: You are solely responsible for the content of your interactions with DAHLIA and any output or communications (such as emails or messages) that you instruct DAHLIA to generate or send. You will review and verify the content that DAHLIA prepares for you (like email drafts) before using it, to ensure it is accurate and appropriate.  

- Respect Third‑Party Rights: Only provide or direct DAHLIA to access content or accounts that you own or have permission to use. You will not use DAHLIA to violate anyone else’s rights, including privacy, intellectual property, or contractual rights.  

You understand that you are responsible for any actions DAHLIA takes on your behalf based on the instructions and permissions you provide. For example, if you ask DAHLIA to send an email or schedule a meeting, it will do so as if you took that action, and you are accountable for the content and outcome of that action. Always use the Service with care and review actions performed by DAHLIA to ensure they meet your expectations.


Acceptable Use Policy

You agree NOT to misuse the DAHLIA Service, including but not limited to:  

- Using the App for any illegal, harmful, fraudulent, or unauthorized purpose, or engaging in any activity that violates any law or regulation.  

- Harassing, threatening, or impersonating any person, or transmitting content that is defamatory, obscene, invasive of privacy, or otherwise objectionable.  

- Sending unsolicited or mass communications (“spam”) or otherwise using messaging features in violation of anti‑spam laws.  

- Attempting to gain unauthorized access to any system, account, or data through the Service, or interfering with its performance.  

- Reverse‑engineering or attempting to discover source code or algorithms, except where permitted by law.  

- Violating the terms of any third‑party service integrated with the App.  

- Uploading or distributing viruses, malware, or harmful code via the App.

If you violate this Acceptable Use Policy or any other provision of these Terms, we may suspend or terminate your access to DAHLIA (see Termination). You are responsible for any legal consequences caused by your breach of these Terms.


Third‑Party Services and Integrations

DAHLIA works in conjunction with third‑party services. By using DAHLIA, you acknowledge and agree that:

- Apple Services: DAHLIA connects with Apple’s iCloud services (Mail, Calendar, Reminders) using your credentials. Your use of Apple services via DAHLIA must comply with Apple’s terms and policies. We are not responsible for downtime, interruptions, or errors caused by Apple’s services, or for changes Apple makes that affect DAHLIA’s functionality.  

- OpenAI API: DAHLIA’s AI‑powered features are delivered through OpenAI’s API. We have opted‑out of data usage for training where possible. By using DAHLIA’s AI features, you consent to your content being processed by OpenAI to generate responses. We are not liable for any AI‑generated content or actions taken in reliance on that content.  

- Hosting and Other Providers: DAHLIA’s backend and data storage are hosted on third‑party infrastructure (e.g. Heroku). We strive for reliability and security but cannot guarantee continuous availability or security of third‑party services.


Privacy and Data Use

Your privacy is important to us. Highlights:  

- We collect only the data necessary to provide and improve the Service and never sell your personal data.  

- All transmissions are encrypted; sensitive credentials are encrypted at rest.  

- We retain data only as long as necessary and give you control over your personal information.

Payments and Subscription

DAHLIA is offered as a subscription service billed through the Apple App Store. Key points:  

- Auto‑Renewal: Subscriptions renew automatically each month unless canceled at least 24 hours before the period ends.  

- Manage or Cancel: You can cancel anytime in your Apple ID > Subscriptions settings.  

- No Partial Refunds: We do not provide refunds for unused portions of a billing period; requests must go through Apple.  

We reserve the right to change fees; Apple will notify you of any price increase in advance.


Intellectual Property Rights

All rights in the DAHLIA App and Service belong to DAHLIA Intelligence Inc. You receive a limited, non‑transferable license to use the App for personal, non‑commercial purposes. All your content remains yours; you grant us a limited license to process it solely to operate the Service.


Disclaimer of Warranties

DAHLIA is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee that the Service will be error‑free, uninterrupted, or that content will be accurate or reliable.


Emotional and Mental Health Disclaimer

DAHLIA is not a substitute for professional mental‑health care. If you experience distress or crisis, seek help from a qualified professional or emergency services immediately.


Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages. Our aggregate liability is capped at the amount you paid in the 12 months before the claim (or US $100 if you paid nothing).


Indemnification

You agree to indemnify DAHLIA Intelligence Inc. for losses stemming from your misuse of the Service, violation of these Terms, or infringement of third‑party rights.


Termination

You can stop using DAHLIA at any time and cancel your subscription through Apple. We may suspend or terminate your access for violations or other valid reasons.


Modifications to the Service and Terms

We may update DAHLIA or these Terms from time to time. Continued use after updates constitutes acceptance. If you disagree, stop using the Service.


Governing Law

These Terms are governed by the laws of Nova Scotia and Canada, without regard to conflict‑of‑laws rules.


Dispute Resolution and Arbitration

Please read the arbitration agreement carefully. You can opt‑out within 30 days of accepting these Terms. Otherwise, most disputes must be resolved by binding arbitration on an individual basis.

Acknowledgment and Acceptance

By downloading or using DAHLIA, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy. Continued use signifies acceptance of any future updates.
